Push IT — Terms of Service

Tarah’s Promise

These Terms exist so you and I both know what we’re agreeing to. I built Push IT to help neurodivergent brains run their lives without shame. These Terms protect that mission and protect you.

 

1. Agreement

By downloading, creating an account, or using the Push IT mobile app (“Push IT,” “the app”), you agree to these Terms of Service. Push IT is operated by Outcast Enterprise LLC (“Outcast Enterprise,” “we,” “us,” “our”), a Florida limited liability company.

If you don’t agree to these Terms, please don’t use the app.

2. Eligibility

You must be at least 18 years old to use Push IT. By using the app, you confirm you meet this age requirement.

3. What Push IT Is — and What It Is Not

Push IT is a productivity and accountability tool that helps you track tasks, estimate time, build streaks, and share your progress with people you choose.

Push IT is not:

– A medical device
– A treatment for ADHD, autism, anxiety, depression, or any other condition
– A diagnostic tool
– A substitute for therapy, coaching, medical care, or professional advice
– A clinical record system

The data Push IT generates is self-reported activity data. It is not a clinical record and should not be used to diagnose, treat, or make medical decisions. If you are in crisis, contact a qualified professional or local emergency services.

4. Your Account

You are responsible for:

– Keeping your login credentials secure
– All activity that happens under your account
– The accuracy of the information you log
– Notifying us immediately if your account is compromised (contact@outcastenterprise.com)

5. Subscription Terms

Push IT offers paid subscriptions. Depending on where you subscribe, billing is handled by one of two providers:

– In the Android app: Google Play Billing (your subscription is managed through your Google Play account)
– On our website (outcastenterprise.com): Stripe

Pricing (subject to change with notice)

– Monthly: $6.99 per month
– Annual: $49 per year (saves over 40% vs. monthly)

Free Trial

New subscribers receive a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your selected plan will automatically begin and the first payment will be charged.

Auto-Renewal

Subscriptions automatically renew at the end of each billing cycle (monthly or annual) at the then-current price. You will be charged automatically using the payment method on file.

Cancellation

– If you subscribed through the Android app: cancel anytime through the Google Play Store (Play Store → Profile → Payments & subscriptions → Subscriptions → Push IT).
– If you subscribed through our website: cancel anytime through Manage Subscription in your account (powered by Stripe).

Cancellation takes effect at the end of your current billing period. You’ll keep access until then.

Refunds

Subscription payments are generally non-refundable because Push IT provides ongoing access to a service. Purchases made through Google Play are also subject to Google Play’s refund policies. If you experience a billing error or technical issue, contact us at contact@outcastenterprise.com and we’ll review on a case-by-case basis. We honor refunds where required by applicable law.

Price Changes

We may change subscription prices in the future. We’ll notify you before any change takes effect, and you can cancel before the new price applies.

6. The Share Feature

Push IT lets you generate PDF reports and share them with anyone you choose using your phone’s native share menu.

By using the share feature, you acknowledge:

– You initiate every share. Push IT does not send anything to anyone without you tapping Share.
– You choose the recipient. We do not select, contact, or maintain a list of your recipients.
– You control what happens after. Once you’ve shared a report, what the recipient does with it is between you and them.
– You bear sole responsibility for distribution. By sharing your report with someone (whether a therapist, coach, parent, doctor, friend, or anyone else), you acknowledge you are sending your personal data to a third party at your own discretion.
– Reports are self-reported activity, not clinical records. Recipients should treat the content as user-logged information, not medical or clinical data.

7. Acceptable Use

When using Push IT, you agree not to:

– Use the app for any illegal purpose
– Attempt to access another user’s account
– Reverse-engineer, decompile, or hack the app
– Scrape, copy, or redistribute Push IT content or features
– Use the app to harass, harm, or impersonate anyone
– Upload tasks or notes containing illegal, threatening, or abusive content
– Misuse the share feature to distribute someone else’s data without consent

We may suspend or terminate accounts that violate these rules.

8. Intellectual Property

The Push IT app, including its name, design, mascot, logos, the “Outcast Enterprise™” mark, the phrase “Why? Because Tarah said so.,” and all related content, is owned by Outcast Enterprise LLC. You may not copy, modify, or redistribute any part of the app without written permission.

You retain ownership of the data you create in the app (your tasks, notes, attachments). By using the app, you grant us a limited license to store, display, and process that data solely to provide the service to you.

9. Disclaimers

Push IT is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

– No medical claims. Push IT does not diagnose, treat, or prevent any condition.
– No accuracy guarantee for self-reported data. The app reflects what you log. We are not responsible for the accuracy of your timer entries, task estimates, or notes.
– No guaranteed outcomes. Individual results vary. The app is a tool, not a promise.

10. Limitation of Liability

To the maximum extent permitted by law:

– Outcast Enterprise LLC is not liable for indirect, incidental, consequential, special, or punitive damages.
– Our total liability for any claim related to Push IT is limited to the amount you paid us in the 12 months before the claim arose, or $50, whichever is greater.
– We are not responsible for how third parties (therapists, coaches, parents, doctors, employers, friends) interpret or act on data you choose to share with them.

Some jurisdictions don’t allow these limits, so they may not fully apply to you.

11. Termination

You can stop using Push IT and delete your account at any time through Settings → Delete Account.

We may suspend or terminate your account if you violate these Terms, misuse the service, or for legal reasons. If we terminate your account for cause, no refund is owed.

12. Changes to These Terms

We may update these Terms. If we make material changes, we’ll notify you through the app or by email at least 14 days before the changes take effect. Continued use after the effective date means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law rules. Any dispute arising from these Terms or your use of Push IT will be resolved in the state or federal courts located in Florida, and you consent to that jurisdiction.

If any part of these Terms is found unenforceable, the rest remain in effect.
